Privacy Policy

Chartwell Shipping Ltd. (“Chartwell,” “we,” “us”) is committed to protecting the privacy of our customers, partners, employees, and website visitors. This Privacy Policy describes how we collect, use, disclose, and safeguard personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

This Policy applies to personal information collected by Chartwell through our websites, customer portals, email and telephone correspondence, freight forwarding and customs brokerage services, recruitment activities, and in-person interactions at our offices and facilities across Canada.

  • Contact and identification information: name, business title, employer, mailing address, email address, telephone number.

  • Commercial information: shipment details, consignee and shipper information, commodity descriptions, declared values, customs documentation, and billing details.

  • Customs brokerage information: Business Number, GST/HST registration, importer of record details, and information required by the Canada Border Services Agency (CBSA) and other government agencies.

  • Financial information: credit references, payment instructions, banking details for EFT, and credit history (with consent).

  • Recruitment information: résumés, employment history, references, and credentials, where applicable.

  • Website and technical information: IP address, browser type, device identifiers, pages visited, referring URLs, and cookie data.

How We Collect Information

We collect personal information directly from you when you request a quote, open an account, tender goods for shipment, authorize us to act as your customs broker, apply for employment, subscribe to our communications, or use our website. With your consent, or as permitted by law, we may also collect information from third parties such as credit bureaus, carriers, government agencies, and publicly available sources.

Purposes of Use

We use personal information for the following purposes:

  • To provide freight forwarding, transportation arrangement, warehousing, and customs brokerage services.

  • To prepare and file customs documentation with CBSA and other regulatory bodies.

  • To establish and manage accounts, assess creditworthiness, invoice, and collect payment.

  • To communicate with you about shipments, quotations, service updates, and regulatory changes.

  • To comply with legal, regulatory, tax, and reporting obligations, including under the Customs Act, the Transportation of Dangerous Goods Act, and applicable sanctions and export control laws.

  • To prevent fraud, secure our systems, and protect our rights and the rights of others.

  • To recruit, evaluate, and onboard employees and contractors.

  • To improve our website, services, and customer experience.

SECTION 6

Consent

We obtain your consent before collecting, using, or disclosing personal information, except where authorized or required by law. Consent may be express (written or verbal) or implied through your dealings with us (for example, when you tender a shipment or instruct us to clear goods through customs). You may withdraw consent at any time, subject to legal and contractual restrictions, by contacting our Privacy Officer; however, withdrawal may prevent us from continuing to provide certain services.

Disclosure to Third Parties

We disclose personal information only as necessary to deliver our services and meet legal obligations. Recipients may include:

  • Ocean, air, rail, and trucking carriers, terminals, ports, and warehouse operators involved in your shipment.

  • Foreign agents and overseas partners who handle the destination or origin portion of an international shipment.

  • The Canada Border Services Agency, the Canada Revenue Agency, Transport Canada, and other Canadian or foreign government authorities.

  • Banks, payment processors, credit bureaus, and insurance providers.

  • Professional advisors, auditors, and legal counsel, under duties of confidentiality.

  • IT service providers, including cloud hosting and software vendors, under written contracts requiring appropriate safeguards.

 

We do not sell or rent personal information for marketing purposes.

SECTION 8

Transfers Outside Canada

Because we coordinate international shipments and use service providers located outside Canada, personal information may be processed, stored, or accessed in the United States and other jurisdictions. While in those jurisdictions, personal information may be subject to local laws, including lawful access by foreign courts, law enforcement, and national security authorities. We use contractual and technical safeguards to require comparable protection to that provided in Canada.

SECTION 9

Safeguards

We protect personal information using physical, organizational, and technological safeguards appropriate to its sensitivity, including controlled access to our offices and systems, role-based permissions, encryption in transit, secure disposal of records, employee confidentiality obligations, and regular security training. No method of transmission or storage is perfectly secure; we work continually to maintain and improve our protections.

SECTION 10

Retention

We retain personal information only as long as necessary to fulfill the purposes for which it was collected and to meet our legal, regulatory, and contractual obligations. Customs records are retained for a minimum of six (6) years following the importation of goods, as required by CBSA. When no longer required, personal information is securely destroyed, erased, or anonymized.

Your Rights

Subject to limited exceptions under PIPEDA, you have the right to access the personal information we hold about you, to request correction of inaccurate information, and to be informed of how it has been used and to whom it has been disclosed. To exercise these rights, please submit a written request to our Privacy Officer. We will respond within thirty (30) days. There is no fee for reasonable access requests; we will advise you in advance if any cost applies.
